Conditions of sale

These terms of sale are concluded on the one hand by Amokiss hereinafter referred to as «The Seller» and on the other hand, by any natural or legal person wishing to make a purchase via the website of the «Seller» hereinafter referred to as «the Buyer».

Objet

​

These terms of sale are intended to define the contractual relations between the Seller and the Buyer, and the conditions applicable to any purchase made through the Seller’s merchant site, whether the Buyer is a professional or a consumer. The acquisition of a good or service through this site implies an unreserved acceptance by the Buyer of these conditions of sale. These conditions of sale shall prevail over any other general or special conditions not expressly agreed by the Seller. The Seller reserves the right to modify its terms of sale at any time. In this case, the applicable conditions will be those in force on the date of the order by the Buyer.

Characteristics of the goods and services offered

The products and services offered are those listed in the catalogue published on the Seller’s website. These products and services are offered within the limits of available stocks. Each product is accompanied by a description drawn up by the supplier; the Buyer may have access to the supplier’s documentation. The photographs in the catalogue are as faithful as possible but cannot ensure a perfect similarity with the product offered, especially regarding colors.

 

Prices

The prices in the catalogue are TTC prices in euro, taking into account the VAT applicable on the day of the order; any change in the rate may be reflected in the price of the products or services.

The Seller reserves the right to change its prices at any time, however it is understood that the price appearing in the catalogue on the day of the order will be the only applicable to the Buyer. Prices include (or do not include) the costs of order processing, transport and delivery as long as they take place in the geographical areas provided below.

Commands

The Buyer, who wishes to purchase a product or service must:

• specify your payment and delivery method

• complete the identification form on which he will indicate all the requested contact details or give his customer number if he has one

• fill in the order form online giving all references of the chosen products or services

• validate your order after checking it

• make the payment under the conditions provided

• confirm your order and payment

The confirmation of the order implies acceptance of these conditions of sale, recognition of having full knowledge and waiver to rely on its own purchase conditions or other conditions. All the data provided and the recorded confirmation will be proof of the transaction. The confirmation will be deemed to be a signature and acceptance of the transactions carried out. The Seller will send an e-mail confirming the order.

Withdrawal

​

Buyers, natural persons not professional, have a withdrawal period of fourteen days (14) from the delivery of their order to return the product to the seller for exchange or refund (return or exchange costs at the expense of the buyer).

Payment terms

​

The price is due upon order. Payments will be made by means described by the merchant among:

The Buyer’s account will be debited:

• to order for payment methods by PayPal and credit card via the online payment platform Stripe.

 

At the Buyer’s request, a paper invoice showing VAT will be sent to him.

Deliveries

​

Deliveries are made to the address indicated in the order form which may only be in one of the agreed geographical areas.  In case of damage during transport, the reasoned protest must be made to the carrier immediately on the consignment note, no recourse is possible after.

Delivery times are 15 days from receipt of your payment; beyond 15 days from the order, the sales contract can be terminated and the Buyer refunded.

 

Guarantee

All products supplied by the seller are covered by the legal guarantee provided for in articles 1641 and following of the Civil Code. In case of non-conformity of a product sold, it may be returned to the seller who will take it back, exchange it or refund it. All claims, exchange or refund requests must be made by post to the address of the Seller within thirty days of delivery.

Responsibility

The Seller, in the process of online sales, is only bound by an obligation of means; his liability may not be incurred for any damage resulting from the use of the Internet such as loss of data, intrusion, virus, service disruption, or other involuntary problems.

Intellectual property

All elements of the Seller’s website are and remain the intellectual property and exclusive property of the Seller. No one is allowed to reproduce, exploit, retransmit or use in any way, even partially, the elements of the site whether they are software, visual or sound.

Personal data

In accordance with the law on data processing, files and freedoms of 6 January 1978, personal information relating to buyers may be processed automatically. The Seller reserves the right to collect information about buyers including using cookies, and if it wishes to transmit to business partners the collected information. Buyers may object to the disclosure of their contact information by reporting it to the Seller. Users also have the right to access and correct data concerning them, in accordance with the law of 6 January 1978. The automated processing of information, including the management of the e-mail addresses of users of the site has been declared to the CNIL.

Archiving - Evidence

​

The Seller will archive the purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code. The Seller’s electronic records shall be considered by the parties as evidence of communications, orders, payments and transactions between the parties.

Dispute resolution

These online sales conditions are subject to French law. In case of dispute, the competent courts shall be assigned jurisdiction, notwithstanding any plurality of defendants or appeal to guarantee.
